Barry Sheets and Chuck Michaelis dissect the recent act passed by the Alaska legislature which demands that lands held by the federal government in violation of Article I, §8 of the US Constitution. We discuss some of the history and nuances of what the Constitution says about the federal government’s power to “own” (we also discuss why the word “own” is in quotes) land within state boundaries.
